PATENTS

A creation, to be patentable, must be different from anything that exists or has already been described, anywhere in the world. This difference cannot be obvious (for example, a simple color change).

 

The invention must also have industrial application.

INDUSTRIAL DESIGNS

The industrial design registration protects an ornamental or visual configuration of two-dimensional objects (such as fabric patterns) or three-dimensional objects. It does not protect its functionality, but they have to be new, original and have industrial application.

The protection of an industrial design registration can last up to 25 years.

The registration of industrial designs does not protect art, such as paintings or sculptures, these creations are protected by copyright law.

TRADEMARKS

Trademarks are names, images, their combination or three-dimensional objects that identify products, services or their origin.

When thinking about registering a new trademark, it is important to check whether it was granted for third parties.

If a trademark is known abroad and not registered in Brazil, it does not mean that it is free to be appropriated by third parties.

SOFTWARE

The protection of the rights related to computer programs is independent of registration. However, registering the program with the BPTO guarantees greater legal certainty to its holder, in case, for example, there is a legal demand to prove the authorship or ownership of the program.

 

In addition, the protection is not territorial as in the case of patents, but its protection is international, comprising all 179 signatory countries of the Berne Convention (1886).

INTEGRATED CIRCUIT

Integrated Circuit Topographies are images, built or encoded in any medium or form, that represent the three-dimensional configuration of the layers that make up an integrated circuit. In other words, it is the design of a chip.
